There have been 4 Judicial Reviews which have relevance to the Draft Neighbourhood Plan. These are:
- Judicial Review of the former Mendip District Council’s decision of September 2019 that the draft Neighbourhood Plan should proceed to Parish Referendum. This claim was dismissed by the High Court but allowed on Appeal to the Court of Appeal. Details are on this website here.
- Judicial Review of the decision by Mendip District Council to adopt Local Plan Pt 2 in December 2021. Historical documentation can be seen here, with the Judgment and Order here.
- Judicial Review of Mendip District Council’s decision to amend the Policies Map to show site NSP1 as outside village development limits. Details are here.
- Judicial Review of the Decision made by Somerset Council that the Neighbourhood Plan could proceed to Referendum. The claim, lodged by Lochailort Investments Ltd, was successful and on 5th July 2026 the High Court issued an Order quashing both the decision to send the Neighbourhood Plan to Referendum and the results of that Referendum.
