Judicial Review of MDC’s Decision to adopt LPP2

This page contains links to some of the historical documents that relate to NSP PC’s decision to apply for a Judicial Review of Mendip District Council’s decision to adopt Local Plan Part 2 in December 2021. The Judgment and Order can be seen here.

Following the Court Order, MDC amended the Policies Map showing the former allocated NSP1 site as outside the village development boundary. Lochailort Investments Ltd challenged this decision by way of a Judicial Review. This challenge was dismissed and permission to appeal not granted. Some of the documents relating to this challenge are here.

The Order was amended following an application by Somerset Council to vary the dates set by the Judge for consulting on and submitting allocations for Examination by the Planning Inspectorate for the ‘505’. The amended Order is here.
